The Rights of Persons with Disabilities Act, 2016 : Applicability to GDS.
The Rights of Persons with Disabilities Act, 2016 is the disability legislation passed by the Indian Parliament to fulfill its obligation to the United Nations Convention on the Rights of Persons with Disabilities, which India ratified in 2007. The Act replaces the existing Persons with Disabilities Act, 1995.( Equal opportunity protection of rights and full participation )
According to Chapter II , section 3(2) : The appropriate Government shall take steps to utilize the capacity of persons with disabilities by providing appropriate environment.
in c/w GDS , this is nothing but providing suitable job for these GDS.
For ex. If a disabled GDS working as GDS PKR/MC/MD , Govt.of India mandatorily take the steps to provide suitable post for working as GDS.i.e, Without quoting the transfer orders released by DoP, they must allow these type of GDS officials from GDS PKR/MC/MD to GDS BPM.
