Proposed Indefinite Hunger Strike from 12.03.2018 at Visakhapatnam, Andhra Pradesh Circle by NUGDS(FNPO).

#Demands :

1.  The earlier nomenclature of GDS (Conduct &Service) Rules May be restored to enable the GDS to enjoy civil servant status. Accordingly the present GDS rules may be modified.

2.  The existing Rule 3A  (1) may be modified to enable the Sevaks to get pay and allowances as per work load following the law laid down by the Supreme Court i.e.  Equal pay for equal work.

3.  To implement the recommendations of GDS Committee report forthwith.

4.  To take necessary steps to avert further trade union action.

Article 309 in the Constitution Of India 1949

Recruitment and conditions of service of persons serving the Union or a State Subject to the provisions of this Constitution, Acts of the appropriate Legislature may regulate the recruitment, and conditions of service of persons appointed, to public services and posts in connection with the affairs of the Union or of any State: Provided that it shall be competent for the President or such person as he may direct in the case of services and posts in connection with the affairs of the Union, and for the Governor of a State or such person as he may direct in the case of services and posts in connection with the affairs of the State, to make rules regulating the recruitment, and the conditions of service of persons appointed, to such services and posts until provision in that behalf is made by or under an Act of the appropriate Legislature under this article, and any rules so made shall have effect subject to the provisions of any such Act

Article 310 (1) in the Constitution Of India 1949

Tenure of office of persons serving the Union or a State.

Except as expressly provided by this Constitution, every person who is a member of a defence service or of a civil service of the Union or of an all India service or holds any post connected with defence or any civil post under the Union, holds office during the pleasure of the President, and every person who is a member of a civil service of a State or holds any civil post under a State holds office during the pleasure of the Governor of the State.

Article 311(2) in the Constitution Of India 1949

No such person as aforesaid shall be dismissed or removed or reduced in rank except after an inquiry in which he has been informed of the charges against him and given a reasonable opportunity of being heard in respect of those charges Provided that where it is proposed after such inquiry, to impose upon him any such penalty, such penalty may be imposed on the basis of the evidence adduced during such inquiry and it shall not be necessary to give such person any opportunity of making representation on the penalty proposed: Provided further that this clause shall not apply

(a) where a person is dismissed or removed or reduced in rank on the ground of conduct which has led to his conviction on a criminal charge; or

(b) where the authority empowered to dismiss or remove a person or to reduce him in rank ins satisfied that for some reason, to be recorded by that authority in writing, it is not reasonably practicable to hold such inquiry; or

(c) where the President or the Governor, as the case may be, is satisfied that in the interest of the security of the State, it is not expedient to hold such inquiry

As per Supreme Court of India in the case of Supdt.of Post Offices vs P.K.Rajamma it is clearly stated that "GDS posts are Civil Post under the direct controle of the State".

It is furnished as follows

This Court in the case of State of Assam and others v. Kanak Chandra Dutta(1) has explained what a civil post is. In that case the respondent who was a Mauzadar in the Assam Valley was dismissed from service in disregard of the provisions of Article 311 (2). It was held that "having regard to the existing system of his recruitment, employment and functions", he was "a servant and a holder of a civil post under the State", and therefore entitled to the protection of Article 311(2).

Supreme Court of India observation in this case

" .... a civil post means a post not connected with defence and outside the regular civil services. A post is a service or employment ....... There is a relationship of master and servant between the State and a person holding a post under it. The existence of this relationship is indicated by the State's right to select and appoint the holder of the post, its right to suspend and dismiss him, its right to control the manner and method of his doing the work and the payment by it of his wages or remuneration."

Articles in the Constitution of India which are directly concern to Labour Rights are as follows

In the Constitution of India from 1950, articles 14-16, 19(1)(c), 23-24, 38, and 41-43A directly concern labour rights.

•Article 14 states everyone should be equal before the law

•Article 15 specifically says the state should not discriminate against citizens.

•Article 16 extends a right of "equality of opportunity" for employment or appointment under the state.

•Article 19(1)(c) gives everyone a specific right "to form associations or unions".

•Article 23 prohibits all trafficking and forced labour.

•Article 24 prohibits child labour under 14 years old in a factory, mine or "any other hazardous employment".

Articles 38-39, and 41-43A, however, like all rights listed in Part IV of the Constitution are not enforceable by courts, rather than creating an aspirational "duty of the State to apply these principles in making laws".[1] The original justification for leaving such principles unenforceable by the courts was that democratically accountable institutions ought to be left with discretion, given the demands they could create on the state for funding from general taxation, although such views have since become controversial.

•Article 38(1) says that in general the state should "strive to promote the welfare of the people" with a "social order in which justice, social, economic and political, shall inform all the institutions of national life.

•Article 38(2) it goes on to say the state should "minimise the inequalities in income" and based on all other statuses.

•Article 41 creates a "right to work", which the National Rural Employment Guarantee Act 2005 attempts to put into practice.

•Article 42 requires the state to "make provision for securing just and human conditions of work and for maternity relief".

•Article 43 says workers should have the right to a living wage and "conditions of work ensuring a decent standard of life".

•Article 43A, inserted by the 42nd Amendment of the Constitution of India in 1976,[2] creates a constitutional right to codetermination by requiring the state to legislate to "secure the participation of workers in the management of undertakings".
