NJCA MEETING DECISION
INDEFINTE STRIKE FROM 1ST WEEK OF MARCH 2016

      Meeting of the National Joint Council of Action (Railways, Defence and Confederation) was held on 08.12.2015 at JCM National Council Staff Side office, New Delhi. Detailed deliberations on 7th CPC related issues (including Gramin Dak Sewaks and Casual, Contract and daily-rated workers) was held and a Common charter of demands was finalized. It is further decided that the NJCA shall go on indefinite strike from the 1st week of March 2016, if the Government fails to reach a negotiated settlement with the staff side before 1st week of February 2016. A letter intimating this decision will be given to the Government shortly along with the common charter of demands. Letter to Government and charter of demands will be published in the website within two days.

Memorandum submitted to Department by the

 both Federations regarding GDS dated        08.12.2015


Departmental council meeting was held on 8th Dec 2015 under the Chair of Secretary (P).  7th CPC related issues are discussed. Both Federations submitted joint Memorandum given as under.   The meeting discussed all the matters cadre wise. Secretary responded favorably for our demands. Let us hope for the best.


Gramin Dak Sevaks (GDS)
Eventhough the Government repeatedly refused to include the Gramin Dak Sevaks under the purview of 7th CPC, the 7th CPC suo-moto reviewed the case of Gramin Dak Sevaks (GDS) and made the following most damaging and retrograde recommendations regarding Gramin Dak Sevaks.

Para 11.8.50 - Government of India has so far held that the GDS is outside the civil services of the Union and shall not claim to be at par with the Central Government employees. The Supreme Court Judgment also states that GDS are only holders of civil posts but not civilian employees. The Commission endorses this view and therefore has no recommnedations with regard to GDS.

We strongly disagree with the above observations of the 7th CPC. In Chapter XXXVIII of our memorandum submitted to 7th CPC, we have explained all the legal points regarding grant of Civil Servant status to GDS.

We furnish below, the observation made in the fourth CPC Report by Hon’ble Justice (Retd.) Supreme Court, Shri. P. N. Singhal, who was the Chairman of the fourth Central Pay Commission, regarding the status of GDS:

“A letter was received from the Ministry of Communications (P&T Board) for exclusion of the Extra Departmental Employees (Now called GDS), numbering about three lakhs, from the purview of our inquiry. It was stated that the system of Extra-Departmental Agents was peculiar to the P&T organsation and was designed to extend postal facilities in rural and backward areas where opening of regular departmental post offices was not justified due to inadequate workload. The remuneration and conditions of service of Extra Departmental Agents were also different from those of regular employees. The third pay commission accepted the view that the Extra-Departmental agents were not holders of civil posts and decided to exclude them from its purview. The matter is, however, beyond controversy after the decision of the Supreme Court in Gokulnandas’ casewhere it has been declared that

 the Extra Departmental Agents is not a casual workers, but “holds” a post under the administrative control of the state” and that while such a post is outside the regular civil services, there is no doubt that it a post under the “state”. In view of this pronouncement, we are unable to accept the contention that Extra- Departmental employees were outside the purview of the terms of our commission”

From the above observation it is clear that fourth CPC was in conclusion that the ED Agents (now GDS) are Civil Servants and therefore they are to be brought under the purview of Pay Commission.

Now the recommendations made by Justice Ashok Kumar Mathur, Chairman 7th CPC, who is also a Retired Justice of the Supreme Court is quite contradictory to the observation made by Justice (Retd) Supreme Court Shri P. N. Singhal, chairman, Fourth CPC.

Further Justice Charanjit Talwar Committee headed by Retired Justice Shri Charanjit Talwar of Delhi High Court, who was the Chairman of the One-man Committee which examined the wages and Service Conditions of Gramin Dak Sevaks (then EDAs) has made the following recommendations in its report submitted to Government.

“Extra Departmental Agents have to be included within the overall class of Civil Servants being holders of civil posts. They can be grouped as “additional” to the departmental employees, but they cannot be classified as a class apart from the Civil Servants. At any rate they cannot be classified with the sole object of not granting them benefits which accrue to departmental employee………………………………. The plea taken by the Department before the second and third Pay Commissions and also before various learned Tribunals that ED Agents are a class apart is entirely misconceived. It is violative of Article 14 and 16 of the constitution…………. They have been held by the Supreme Court to be Civil Servants. Therefore, these employees are required in future to be includedwithin the purview of the Pay Commission…………. It is therefore recommended that whenever it is required to review the service conditions and wage structure of the employees of the Department of Posts, ED Agents be bracketed along with the departmental employees. There is no need to set up a separate committee or commission for ED Agents.”

Here again the recommendations made by Chairman 7th CPC is contradictory to the recommendations of another Judge Shri. Charanjit Talwar.

Thus it can be safely concluded that the 7th CPC has not examined the case of GDS in a fair and judicial manner, but simply repeated the often – repeated arguments of the Postal Board and Government of India to deny Justice to the three lakhs Gramin Dak Sevaks.

We urge upon the Government of India and Departmental of Post to reject the retrograde recommendations of the 7th CPC relating to GDS and treat the GDS as Civil Servants and extend all the benefits of the departmental employees on pro-rata basis to Gramin Dak Sevaks also.

Accounts opened up to 31.10.2015 under Sukanya Samriddhi Yojana (SSA) across the country is 76, 19,668



 The number of accounts opened up to 31.10.2015 under Sukanya Samriddhi Yojana across the country is 76, 19,668. The amount collected under these accounts is Rs. 2838.73 crore. The scheme was notified on 2.12.2014 and the maturity period of accounts opened under the scheme is 21 years. The scheme has completed one year. In this short time, the impact is that 76, 19, 668 girl children got Rs. 2838.73 crore deposited in their name

    Govt forms panel to revisit Gramin Dak Sevaks pay, benefits





The government has formed a committee to review pay structure and social security benefits provided to 'gramin dak sevaks'.


The one-man committee will review and suggest changes in existing wage structures, facilities and other social security benefits provided to 'gramin dak sevaks' (GDS), according to a notification by the Communications and IT Ministry.Gramin dak sevaks are extra-departmental agents recruited by the postal department to serve in rural areas.

They have been demanding pay and facilities at par with regular postal department employees.

"The question of examining the conditions of service and emoluments and other facilities available to the Gramin Dak Sevaks (GDS) has been under the consideration of the Government of India for some time.

The Government has now decided to set up a one-man committee for the purpose," the notification dated November 19 said.

The Committee headed by Retired Member of the Postal Services Board Kamlesh Chandra will go into the service conditions of Gramin Dak Sevaks and suggest changes as considered necessary, it said.

All India GDS Union last week had demanded that the panel should be formed under retired Supreme Court or High Court judge and not under chairmanship of a retired officer.

In the letter to Secretary, Department of Posts, the union said that it will go on one-day hunger strike on November 27 at divisional offices, at circle offices on December 4 and in New Delhi on December 10 if the demand is not met.

The committee will examine the system of branch post offices, employment conditions and the existing structure of wage and emoluments paid to GDS and recommend necessary changes.

It will also "examine and suggest any changes in the method of recruitment, minimum qualification for appointment as Gramin Dak Sevaks and their conduct and disciplinary rules, particularly keeping in view the proposed induction of technology in the Rural Post Offices", the notification said.The Committee will function for a period of one year.

11.8.48 A demand has been made before the Commission for treating Gramin Dak Sewaks
(GDS) as civil servants at par with other regular employees for all purposes.
Analysis and Recommendations
11.8.49 The Commission has carefully considered the demand and noted the following:
a. GDS are Extra-Departmental Agents recruited by Department of Posts to serve in rural
areas.
b. As per the RRs, the minimum educational qualification for recruitment to this post is
Class X.
c. GDS are required to be on duty only for 4-5 hours a day under the terms and conditions
of their service.
d. The GDS are remunerated with Time Related Continuity Allowance (TRCA) on the
pattern of pay scales for regular government employees, plus DA on pro-rata basis.
e. A GDS must have other means of income independent of his remuneration as a GDS,
to sustain himself and his family.
11.8.50 Government of India has so far held that the GDS is outside the Civil Service of the
Union and shall not claim to be at par with the Central Government employees. The Supreme
Court judgment also states that GDS are only holders of civil posts but not civilian employees.
The Commission endorses this view and therefore has no recommendation with regard to GDS.

Recommended Date of implementation: 01.01.2016
Minimum Pay: Based on the Aykroyd formula, the minimum pay in government is recommended to be set at ₹18,000 per month.

Maximum Pay: ₹2,25,000 per month for Apex Scale and ₹2,50,000 per month for Cabinet Secretary and others presently at the same pay level.

Clarification on eligibility age for opening "Sukanya Samriddhi Account " under Small Savings Scheme 

It is clarified that up to 01/12/2015, account can be opened in the name of any Girl child who is born on or after 03/12/2003. There after, it can be opened only if girl is not completed 10 years on the day of opening of account.

Payment of revised remuneration to full / Part Time Casual Labourers - Clarification


Postal Directorate vide its OM no 2-53/2011-PCC dated 22.01.2015 has ordered to pay the revised remuneration to the full/Part time casual laborers. Circle office, Hyderabad has referred back to matter to Directorate vide letter dated 03.08.2015 to clarify the date of effect, Eligibility etc.
Postal Directorate has issued clarification vide letter no 2-53/2011-PCC dated 05.11.2015 which is reproduced below.
